Court deliberations on Site 41 have been adjourned by the presiding judge until August 13-14. Simcoe County is seeking an injunction against Site 41 protesters, and the Council of Canadians’ legal counsel Sack Goldblatt Mitchell is seeking a declaration that current construction at Site 41 is unlawful. A decision on both matters is now expected by August 14.
The Council of Canadians very much regrets the delay in the court determining whether current construction at Site 41 is unlawful, which allows devastating construction at the controversial dump site to proceed. Nevertheless, we are grateful that the judge is seriously weighing our contention that the County has moved forward with the construction of Site 41 without the consideration for proper process. Ultimately our case before the judge and the public is about the need for transparency and accountability in regard to the County’s decision to proceed with Site 41.
As the Council of Canadians has laid out in the public, this decision would be better made by elected representatives of Simcoe County and we will continue to urge them to listen to the clear will of the residents of the area. We believe that there is no reason for County Council to wait any longer to step forward and facilitate the informed debate that should have taken place long ago. We call on the County Council to support an immediate one year moratorium on further construction at Site 41 at their Council meeting at end of August.
Public pressure is tremendous, from the local community, the province and the country. The county needs to responsibly accept this. The Council of Canadians remains committed to protecting the pristine water source of the Alliston Aquifer, some of the purest water on the planet.
